Prosecutors claim James signed a “Second Home Rider” to get a better 3% rate instead of a rate of 3.815% was to be used for investment properties, then did not use the home to reside there and instead rented the home out, which was against the loan requirements.

Neighbors and the Norfolk city tax records confirmed that James had not been a resident of Norfolk, and her tax returns classified the home as a rental property because she made additional income from the rental that year.

James is set to appear in federal court in Norfolk on October 24 in front of Judge Jamar Walker and Magistrate Judge Douglas Miller.
